The National Association for Equal Opportunity in Higher Education is seeking help from Congress, and has asked two key members of Congress to hold hearings to determine if the Education Department's Office for Civil Rights has shirked its responsibility to enforce higher-education desegregation agreements. In particular, leaders are worried that recent actions on the part of two predominantly white institutions are attempts to draw their students away, and angry that the Office of Civil Rights decline to become involved in either case. The organization has given up on filing a federal lawsuit because its leaders believe, given the current state of the law and the ideological balance of the federal courts, that such litigation would be unlikely to prevail. The two cases, one in Maryland and the other in Texas, are discussed.
