Most State public bargaining statutes utilize industrial labor-law language in determining the subjects of bargaining between employers and employees, usually calling for discussion or mandatory bargaining over "terms and conditions of employment." However, the majority of these laws are silent on the exact meaning of this phrase. The question of class size is one of the issues within the "area of silence" in the State statutes.
