The 2020 Title IX Regulations: An Examination of the Rules and What They Mean to Higher Education

The purpose of this study was to evaluate both the U.S. Department of Education's legal rationale for the 2020 amendments to the existing Title IX regulations and the impact of the regulations on the reliability and accuracy of campus sexual assault adjudications in the higher education context. Title IX of the Education Amendments of 1972 is intended to curb sex discrimination within education programs or activities that receive federal financial assistance. Over time, sexual harassment rose to become a prominent Title IX issue. The controversies over campus sexual harassment reached a boiling point in the 2010s, resulting in the U.S. Department of Education issuing regulations specifically addressing how educational institutions must respond to and adjudicate sexual harassment allegations. Although the goal of the regulations was to achieve equity in campus sexual harassment grievance proceedings, the resulting regulations have caused some to contend that they fail to achieve that goal. Legal research was conducted to examine how the regulations align with the judicial precedent that the Department of Education relied upon in drafting the regulations and whether the regulations are likely to achieve the intended results of equitable adjudicative procedures. The research revealed flaws in the Department of Education's reasoning for the regulations' provisions that may ultimately lead to unanticipated complications for institutions of higher education. The study discusses implications and recommendations for future research and practice for the purposes of fulfilling the intent of Title IX.
