Best Practices in Manifestation Determination Meetings to Decrease Disproportionality of Special Education Students Receiving Exclusionary Discipline

Exclusionary discipline is a practice that is used nationwide. Historically, students within Special Education receive exclusionary discipline at a higher rate than their nondisabled peers even though they have the legal protections of a Manifestation Determination meeting. IEP stakeholders, including school psychologists, administrators and teachers have indicated a lack of training, vague guidelines, bias, and a lack of consistency in the decision-making process as factors that impact the Manifestation Determination process. With additional training, resources and the use of Collaborative and Proactive Solutions (CPS), IEP Teams can foster a review meeting that increases fidelity, participation and objectivity to support students on IEPs while decreasing disproportionality within discipline.
