This document consists of two letters issued by the Office of Civil Rights (OCR) of the U.S. Department of Education which discuss the application of Title IX of the Education Amendments of 1972, specifically as it relates to the funding of athletic scholarships for men's and women's intercollegiate athletics programs. Although the letters directly address the 25 complaints being specifically investigated by OCR, they are intended to provide guidance to all schools awarding such scholarships. An introductory letter by the Assistant Secretary, OCR, stresses that such scholarships should be made available to separate men's and women's athletic programs in a manner which is "substantially proportionate" to the participation rates of male and female athletes. The second, more extensive, letter to the General Counsel of Bowling Green University (Ohio) from the national coordinator for Title IX athletics, clarifies the coverage of Title IX and its regulations as they apply to both academic and athletic programs. It specifically discusses the 1979 Intercollegiate Athletics Policy Interpretation of the "substantially proportionate" provision of Title IX as it relates to athletic scholarships. (DB)
