This document presents the text of Public Law 106-229, the "Electronic Signatures in Global and National Commerce Act." The act states that, with respect to any transaction in or affecting interstate or foreign commerce: a signature, contract, or other record relating to such transaction may not be denied legal effect, validity, or enforceability solely because it is in electronic form; and a contract relating to such transaction may not be denied legal effect, validity, or enforceability solely because an electronic signature or electronic record was used in its formation. Title I of the law covers electronic records and signatures in commerce, including sections on the general rule of validity, exemption to preemption, specific exemptions, applicability to federal and state governments, studies, definitions, and effective date. Title II addresses transferable records. Title III discusses promotion of international electronic commerce, including principles governing the use of electronic signatures in international transactions. Title IV amends the Child Online Protection Act, giving the Commission on Online Child Protection the authority to accept gifts. (Contains 17 references.) (MES)
