This report addresses the issue of the extent to which state constitutions permit sectarian schools to be included in a choice program. The issue has arisen in connection with federal proposals to fund school-choice programs subject to the law of each state. If the question is considered without reference to federal funding, the inclusion of sectarian schools in choice programs would seem to be clearly permissible in 12 states, explicitly prohibited in 1, and constitutionally dubious in 6. However, if considered with reference to federal funding, it is uncertain whether any states other than Missouri and Virginia would prohibit sectarian schools from participating in a choice program. This report sets forth the pertinent constitutional provisions and interpretations of the 38 states that have provisions of the types described and draws such general conclusions as the present state of the law permits.
