Academic freedom, collegiality, and tenure are addressed with focus on how collective bargaining affects them. This material is intended to give college and university attorneys a feel for the challenges and problems that collective bargaining has brought to academia. Three sections look at the following: (1) academic freedom (what it is, academic freedom and the United States Constitution, academic freedom and state constitutions, academic freedom privilege in state courts, who the freedom belongs to, and other contexts in which academic freedom issues may arise); (2) collegiality (obligation of the professoriate and institutional governance: traditional views and collective bargaining); and (3) tenure (job security and academic judgments).
