School Officials and the Courts: Update 1986. ERS Monograph.
Beckham, Joseph C.
This monograph is the ninth in a series designed to provide a scope treatment of case laws involving contemporary public school issues. The selections summarize principal judicial decisions drawn from 1985-86 federal and regional reporters. "School Boards and Board Members," part 1, describes decisions on school closures, equal protection violation, and contract arbitration. Part 2, "Administrators," provides illustrations of selection discrimination, due process in dismissal, and sexual harassment. Part 3, "Finance," surveys disparities in state funding among districts and prohibitions on reduction in funding. Statutory rulings are highlighted in "Collective Bargaining and Contract Management," part 4, which includes minority preference in layoffs and employee organization access to school facilities. "Teachers," part 5, concerns federal constitutional and statutory protection in speech, privacy, dismissal, and due process. Part 6, "Pupils," discusses decisions involving the state's interest versus individual rights, including topics such as the Equal Access Act, basis for search, and procedural rights under the Education for All Handicapped Children Act. Part 7, "Religion," includes decisions on creation science, evolution, and home instruction. "Torts and Related Statutory Liability," part 8, examines cases concerning negligence in hiring and damages under the Civil Rights Act. Five pages of reference notes and a glossary of terms conclude the monograph. (CJH)
