The General Education Provisions Act (GEPA) was created in 1968 to take into consideration the specific concerns of education as they relate to the federal regulatory process. Setting down standard procedures for education regulation, the GEPA has created enforcement problems, turf battles, and mountains of regulations. In a major revamping of education regulations presently taking place, every regulation on the book is being reviewed to determine if it is necessary, justified by law, and can be met without undue expense and paperwork. Local school boards are nervous about how these changes will affect them. To give officials enough information to protect their own districts, this chapter attempts to explain the federal regulatory maze and some of the turf battles over control of the process. It also shows how the process should work in theory and notes its pitfalls. (MLF)
