The College Student and the Courts. Revised Edition.
Young, D. Parker; Gehring, Donald D.
Briefs of selected higher court cases involving student/institutional relationships in Higher Education reported through March 31, 1977 comprised the basic case book. Cases reported after March 31, 1977 are included in monthly supplements. Designed for use by students, faculty, and administrators, the case book responds to the "legalistic '60's" and the present sophistication of students who continue to use the courts to resolve their grievances. Basic information on the coverage of the courts, judicial circuits, Constitutional amendments, and "How to Read a Citation" are included in the introduction. In addition, the introduction includes a general discussion of the First Amendment and the due process and equal protection clauses of the Fourteenth Amendment, and the issues involved with those areas are presented as separate chapters. It is suggested that Chapter I be read as a basis for further study, and includes sections on contractual theory, in loco parentis, relationship between the courts and education, and state action. The remaining chapters are presented alphabetically by the primary issue involved in the case such as admissions, athletics, financial aid, scholastic affairs, sex and race, student organizations, symbolic expression, and tuition. A miscellaneous chapter is included for issues difficult to categorize. Federal regulations affecting student/institutional relationships are combined in an appendix. A glossary and a three-part index are also included, as are "The College Student and the Courts" supplements. (LC)
