Redundancies, Re-Organisations, Transfers and Mergers in the Higher Education Sector: Employment Law and Human Resources Aspects
McMullen, John
Perspectives: Policy and Practice in Higher Education, v12 n1 p20-25 Jan 2008
In this article, the author discusses the process of organizational change, focusing on the distinction between contractual terms and conditions and non-contractual working conditions and the effect this distinction has on changes, and on contract termination and redundancy procedures. He then outlines the United Kingdom's Transfer of Undertakings (Protection of Employment) (TUPE) Regulations 2006 as they apply to outsourcing in general and by universities in particular. (Contains 4 footnotes.) [This is part one of a paper based on a Keynote presentation delivered at the AUA Annual Conference, Promoting excellence in HE Management, at the University of Nottingham, 2-4 April 2007.]
