The "Case" of a School Psychologist: The Legal and the Larger Meaning
Zirkel, Perry A.
Communique, v42 n5 p4, 6 Jan-Feb 2014
This article provides the story--from the outside and the inside with a before and after--of an award-winning school psychologist, Rosario Pesce, who faced a professional dilemma midway in his career that led to litigation that went all the way to the federal Seventh Circuit Court of Appeals. The article consists of (1) the facts of the case, which necessarily are the allegations construed in the light most favorable to the plaintiff-school psychologist (because the court decided the case on a motion for dismissal), and the court's legal conclusions; (2) a brief analysis of the decision; (3) a few postcase events under the heading of "Sequellae"; and (4) the protagonist's account of his experience in the form of a question and answer interview conducted via e-mail.
