In his introductory statements, the author notes that grievance arbitration has been the major single source of litigation and that scope of bargaining has become a central issue. These issues reflect the growing fiscal pressures on school boards to reduce positions, close schools, and take other economy measures. The author also notes that the courts and Public Employment Relations Boards (PERBs) are showing a growing acceptance of private sector case law. The major headings of the chapter reflect the important issues discussed: constitutional law issues, authority to bargain, recognition of unions, rights and obligations of exclusive bargaining representatives, scope of bargaining, grievances, judicial review of awards, effect of legislation, impasse and dispute resolution, concerted activity, and PERBs.
