Political Broadcasting after the "Aspen" Ruling: Legislative Reform of Section 315 (a).

This paper offers a discussion of the rulings of the Federal Communications Commission (FCC) related to Section 315 (a) of the Communications Act of 1934--the section concerning equal access to broadcast media by all political candidates. Following a general discussion of Section 315 (a) and the exemptions that are part of the act, the paper then discusses the reinterpretation of the exemption section known as the "Aspen" ruling. This is followed by a presentation of information about legislative reform that followed the "Aspen" ruling and by suggestions for directions for future reform of the act. The paper concludes by suggesting that while the FCC has responded to the problems in the equal opportunities provision, legislative action is needed to establish broad policies. (TJ)
