Cases, Problems, and Materials: An Instructional Supplement to "The Law of Higher Education." Third Edition.
Kaplin, William A.; Lee, Barbara A.
The volume is an expanded and revised edition of informal teaching materials designed for instructional use by both teachers and learners, and is intended to accompany the 1995 text, "The Law of Higher Education: A Comprehensive Guide to Legal Implications of Administrative Decision Making Third Edition" (ED 383 256). The supplement's purpose is to facilitate and enrich the teaching of education law and educational administration in graduate schools of education, law schools, and in professional workshops for administrators and attorneys. The volume is divided into three parts: (1) Introduction and Overview; (2) Cases, Notes, Questions, Problems; and (3) Large-Scale Problem-Solving Exercises. Four types of material are included: those providing an orientation to and suggestions for the study of education law; edited judicial opinions illustrating selected facets of the law's development; notes and questions to enhance understanding of the opinions; and practical problems, along with separate appendices of guidelines for resolving them that explore the law's concrete applications to day-to-day administrative challenges in colleges and universities. Individual chapters address the relationship of the college to: trustees/administrators/agents; faculty; community; state government; federal government; educational associations; and the business/industrial community. Appended is a copy of the Constitution of the United States, with provisions of particular interest to postsecondary education, and guidelines for problems and completing problem-solving exercises.
