Who's in Control? The Courts, the Legislature and the Public in Colorado's School Finance Debate.

This report traces the movement for school funding reform in Colorado. The study analyzes how court-mandated remedies were implemented and seeks to determine what role public engagement played in these reforms. Some have suggested that a general skepticism and lack of confidence in reform in Colorado have delayed funding reform, coupled with such obstacles as strict limits on public spending and a strong desire for local control. Nevertheless, the combined effects of two lawsuits have brought some reforms to the state's school finance system, even without a major victory for the plaintiffs. One suit, "Lujan v. Colorado State Board of Education," addressed spending disparities among school districts. Although the plaintiffs lost this case, it was evident that the Justices of the Colorado Supreme Court agreed on the necessity of changing the state's educational finance laws. "Hafer v. Colorado State Board of Education" alleged a denial of adequate, rather than equal, educational opportunities under the state's revised educational finance law. There is also growing recognition that a statewide dialogue on education finance is critical. The latest legal challenges, especially "Giardino v. Colorado State Board of Education" with its focus on school building construction, may bring about this dialogue. (SLD)
