Reflecting widespread unhappiness with the growing tax burdens in this country, the most active area of litigation reported in the property chapter this year involves various attempts by taxpayers to prevent the construction or remodeling of public school facilities. While some taxpayers fought to keep schools from being built, others in New York and Wisconsin fought to keep them from being closed. In both cases, however, the courts upheld the authority of the school board to close schools and dispose of the property. Unlike last year, nearly all the cases concerning the attachment and detachment of school district land or territory involve conflicts between two or more school districts or between a school district and one or more governmental units. Reflecting the rapid growth of fundamentalist church schools nationwide, the two zoning cases reported dealt with attempts by fundamentalist churches to open religious-oriented schools on or near the church site. This year's section on contracts and bids for building construction continues to be the largest single category of cases. The contract cases involve arbitration, awards, breach of contracts, recovery for materials and services, and wage rate violations. (Author/IRT)
