Texas School Law: A Practical Guide. 1999 Supplement.
Borreca, Christopher P.; Gregory, Raymond L.; Horner, Jeffrey J.; Muzzy, Gray H.
This guide is a supplement to the 1996 edition of "Texas School Law: A Practical Guide." It addresses four topics: real-estate issues relating to school districts and colleges, student-discipline law, education of children with disabilities, and sexual abuse or harassment of students. The first section examines legal changes in the realm of property sales, purchase of real property, and condemnation. Section two discusses Chapter 37, which stipulates that the board of trustees of each school district must adopt a code of student conduct with the advice of its district-level committee. It focuses on suspensions, removal by teachers, placement review, alternative education, expulsions, juvenile courts, tips for discipline cases, and appeals to the school board. The next section discusses the individuals with disabilities education act amendments of 1997, focusing on the funding formula; state eligibility; evaluations, eligibility and terminations, IEPs and placements; individualized education programs; procedural safeguards; and discipline. The last part of the supplement looks at sexual abuse or harassment of students. Topics addressed here include employee-to-student abuse or harassment, including liability issues; claims under Title IX, such as common-law principles and individual liability; and student-to-student harassment.
