The Elementary and Secondary Education Act (ESEA) reauthorization requires State Education Agencies to establish a school choice policy for students attending a persistently dangerous school as defined by the state. No Child Left Behind (NCLB) stipulates that a school can be deemed unsafe as a whole entity or for an individual student who is the victim of a violent criminal offense. In meeting this federal requirement, the Oregon Department of Education seeks to establish and implement a policy that is preventative as well as responsive to parents' immediate concerns. Thus, corrective action is part of the process of designating a school or schools as unsafe or persistently dangerous. This document explains the conditions that need to exist for a public elementary or secondary school to be considered "persistently dangerous" in Oregon.
