For a number of years, colleges and universities have been making efforts to amend past discrimination and noninclusion of underserved minority students through targeted admissions, financial aid, and other programs. Now, these programs--in their original incarnation and, some would say, their original intent--are on the line. The big push to change the complexion of higher education minority programs came after the U.S. Supreme Court decisions in the University of Michigan cases in 2003. These involved challenges to the race and ethnicity decisions in the admissions process at the undergraduate college and the law school. The court concluded that race and ethnicity can be considered as a factor in creating a diverse environment, but not the only factor, and that they must not be considered in a way that is rigid or mechanical. This article discusses the ways in which colleges and universities are attempting to comply with the new rulings.
