The Internet and the Law: What Educators Need To Know.

This book discusses the key legal issues public schools face in using the World Wide Web, e-mail, and other computer technologies. Chapter 1 covers the foundations of school Internet law, including Supreme Court decisions, the legal standard of conduct, standards for technology literacy, and federal vs. state law. Chapter 2 discusses freedom of expression and the school Internet, including what the First Amendment protects, regulating expression on the Internet in schools, out-of-school Internet expression, and the legal significance of student codes of conduct. Chapter 3 addresses privacy and the school-sponsored Internet, including protecting children under 13, cookies, privacy on district and school Web sites, state privacy laws, defamation in Internet communications, and privacy issues in e-mail. Chapter 4 examines the basics of copyright law, including conflicting copyright goals, what is and is not copyrightable, copyright and technology, copyright infringement, recommendations for schools, and Internet acceptable use policies and copyright. Chapter 5 covers copyright and the Internet in schools, including fair use of copyrighted works by teachers and students, caching, linking, works for hire, and trademark infringement. Chapter 6 discusses e-mail and the school Internet, including privacy in e-mail communication, regulating e-mail communications, offensive e-mail, and e-mail harassment. Chapter 7 looks at where we go from here, including the "more is less" issue, protecting opinions and values, involving parents, and what the future may hold. Most chapters include recommendations for schools and annotated legal references. Appendices contain material on formulating acceptable use policies and complying with the Children's Internet Protection Act (CIPA), a suggested list of policies and standard forms for school districts, and general resources.
