An intoxicated father is picking up his daughter from school, in his condition he must be prevented from driving away with his daughter, but what obligations and options guide school owner Sonia Hernandez? The duty to protect the safety of children in the care of a preschool is paramount. However, the laws in most states do not extend to dangers that occur away from the facility. Further, though charged with the duty to protect the health and safety of her students, the laws are unclear whether that duty carries with it sufficient power to override a parent's right to take his child away from the facility.
