Pupil Transportation and the Law. NOLPE Monograph/Book Series, No. 46.
Mawdsley, Ralph D.
Information to aid the school-law specialist in handling transportation issues is provided in this handbook. Following an introduction, section 2 discusses the school's liability for transportation decisions, including school bus safety requirements, selection of transportation, the care owed to students, and school defenses in transportation litigation. The third section examines issues in the school's duty to provide transportation to students, such as governance decisions, general financial considerations, funding, transportation of nonpublic school and special needs students, and transportation for desegregation purposes. Recommendations are made to comply with state/federal requirements to receive reimbursement aid; to develop coherent, consistently enforced policies pertaining to the types of vehicles used for school activities; and to undertake preventative measures at the school/district level. An extensive table of litigation cases is included. (LMI)
