This chapter of "Principles of School Business Management" discusses the implications of several court cases for legal issues affecting the role of the school business official. The issues addressed include civil rights, negligence, contracts, criminal liability, tuition and fees, and student records. The chapter opens with a brief overview of trends in litigation during the 1960s, 70s, and 80s. The broad topic of torts is addressed next. Particular attention is paid to individual rights and the extent of the personal or institutional liability of those who violate these rights; court interpretations of negligence in cases involving schools are also examined carefully, appropriate defenses are noted, and malpractice issues are considered. The chapter then looks at contracts, reviewing the five elements necessary for contract validity. Criminal liability is touched on briefly before the chapter turns to a treatment of the handling of public funds, including assessing and collecting fees and authorizing expenditures. The final topic is the handling of student records, covering factors requiring or limiting the distribution of specific types of information.
