Pot Addiction and Parental Friction: Emotional Disturbance, Conduct Disorders and Unilateral Placements for Drug-Abusing Students Under the IDEA.

This paper is part of a collection of 54 papers from the 48th annual conference of the Education Law Association held in November 2002. It addresses the Individuals with Disabilities Education Act (IDEA). Specifically, the paper examines unilateral placements for drug-abusing and delinquent students. Following the introduction, the next section of the paper presents background information, along with predictions, on private placements for students engaged in drug abuse or serious delinquency. The next section reviews relevant statutes and case law on the major issues connected with such placements, including child find, definitions of disability, appropriateness of private placement, notice requirements, and equitable considerations. The final section offers the following recommendations to school officials to reduce the potential exposure for tuition reimbursements claims: (1) Ensure that all parents and staff are aware of the 10-day prior-notice requirement; (2) insist on full disclosure of all information when parents withdraw a child and pursue a private residential program; (3) demonstrate good faith and a willingness to work with parents toward a return of the student to the public school; and (4) examine carefully the programs and services delivered to the child in the private placement.
