This manual, intended as a training module for professionals involved in providing community-based vocational education, provides a thorough review of the Fair Labor Standards Act (FLSA) as it applies to vocational education, training, and employment of students. Individual sections address the following topics: (1) relationship of the FLSA to other federal initiatives including the Individuals with Disabilities Education Act, the Rehabilitation Act of 1973, and the Americans with Disabilities Act; (2) other applicable federal and state wage/hour laws; (3) specific requirements of the FLSA including guidelines for community-based educational programs for students with disabilities; and (4) conditions under which subminimum wages can be paid under the FLSA. Appendices comprise the bulk of the document and include: overhead transparencies; guidelines for implementing community-based educational programs for students with disabilities; compliance checklists; examples of Department of Labor application forms; a handy reference guide to the FLSA; a copy of the Fair Labor Standards Act of 1938 as Amended; regulations concerning hours worked, records to be kept by employers, and child labor requirements in agricultural and nonagricultural occupations; requirements concerning certificates of age; and requirements for the employment of workers with disabilities under special certificates.
